2. Applicability and Conditions
Our general terms and conditions apply to every offer from us as a web retailer to you as a consumer (any natural person who acquires or uses products or services placed on the market for non-professional purposes only).
We deliver both in Belgium and the Netherlands.

By placing an order you indicate that you agree with the delivery and payment conditions, which are always available via the website.
3. Our offer and your order
If an offer has only a limited period of validity or is subject to certain conditions, we will expressly state this in our offer.
We always describe as completely and accurately as possible what we sell you and how the ordering process will proceed. The description is always sufficiently detailed to allow you to make a good assessment.

If we use images, they are a true representation of the goods and/or services offered.
Your order is complete and the agreement between us is final as soon as we confirm your order by e-mail and as soon as we have received approval from the card issuer for your payment transaction with credit or debit cards. We accept payments via credit card or online banking. If the issuer of your card refuses to authorize your payment to us, we cannot be held responsible for delays in the delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.
To purchase a product, add the product to your shopping cart. You always enter your contact details and/or billing information. Your purchase is final upon payment.
When placing your order, you should thoroughly check your own address. After all, errors in the specified address are the responsibility of you as a customer. When an order returns to us due to you as a customer providing an incorrect or incomplete address, a fee of 6.00 euros will automatically be charged to resend the package to your correct address.
Even if your package is not collected at the post office, you as a customer must pay a fee of 6.00 euros for resending or canceling your package.
In the event of late payment by the customer or problems with payments of previous orders, MISS CHIEF is authorized to dissolve an agreement.
4. Right of withdrawal
If you purchase goods or services from us, you have the right to return them for 14 calendar days from delivery.
We expressly ask you to email a return request to info@miss-chief.be within 14 calendar days of receipt, stating your order number and the relevant product.
You will then receive a return label from MISS CHIEF via email.
Within 14 calendar days after we have received your order back, we will refund the full purchase price to the same account you used to pay when you placed your order.
The costs for returning goods are for your own account.
We will withhold reimbursement until we have received the goods back or until you have provided evidence of having sent back the goods, whichever comes first.
During the first 14 calendar days after delivery, we expect you to handle the order and packaging with care. If you still want to be able to return the goods as described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep the goods. Returned goods may be appropriate, but may not have been used, and the label must still be attached to the item. If you return the goods, this must be done together with the original packaging, with all accessories supplied and in the original condition and packaging and taking into account our instructions below.
You can return your return package by post or bring it in (Seringenstraat 14, 2340 Beerse).
5. Price
During the period stated in our offer, our prices do not change, except for price changes due to changes in VAT rates.
Our prices include all taxes, VAT, duties and services.
So you will never be faced with surprises. We can, however, decide to charge the shipping costs in addition to the purchase price. In that case, we will always report this before you finalize your purchase.
6. Payment
We can only accept payment via the payment methods on our website.
To guarantee a secure online payment and the safety of your personal data, the transaction data is encrypted.
7. Conformity and Warranty
We guarantee that our goods are in conformity with your order and meet the normal expectations you may have of them, taking into account the specifications of the product.
We also guarantee that our goods comply with all existing laws at the time of your order.
8. Delivery and performance
All goods and services are delivered to the address specified by you in your order. MISS CHIEF cannot be held responsible in any way for errors made by the customer when entering the delivery and/or billing address, which may lead to delays in delivery or the impossibility of delivering the products ordered.
Subject to exceptions, which will be stated at the time of delivery, the purchased products will be shipped by us within 2-3 working days after order and payment.

If a product is not in stock, the customer will be informed by e-mail about a later delivery date. If the customer does not agree with the delay, the ordered product can be canceled or the customer can order an alternative product. The canceled product will be refunded or, if an alternative product is ordered, the overpaid/underpaid amount will be refunded/additionally invoiced.

MISS CHIEF determines which carrier will deliver the goods purchased by the buyer.

If we cannot deliver on time, we cannot be held liable.
Our shipments are always at our risk. So you don't have to worry about goods getting lost in the mail. However, if you return goods to us within 14 calendar days of purchase because you have canceled your purchase, you are responsible for the transport.

If the goods delivered by us were damaged during transport, and do not correspond to the items you ordered, you must report this within 3 days and return the items to us within 14 calendar days of receipt. The return costs are for our account.

We cannot be held responsible for any consequential damages due to late delivery or non-delivery by the carrier appointed by the company. Our liability in such cases is limited to the value of the items which are shown not to have been received by the customer.
9. Gift Card
Gift vouchers are valid for 1 year.
If the purchase amount of the product is lower than the value of this gift voucher, MISS CHIEF will send a new code equal to the value of the difference. The validity of this gift voucher is equal to that of the first issued gift voucher.
If the purchase amount of the product is higher, additional payments are required.

Discount codes can be combined with a gift voucher, which serves as a regular means of payment.

In the event of loss, theft or illegibility of both discount codes and gift vouchers, the responsibility always lies with the consumer. Writing errors in the consumer's e-mail address also mean nothing to MISS CHIEF.
10. Force majeure
In case of force majeure, we are not obliged to fulfill our obligations. In that case, we can either suspend our obligations for the duration of the force majeure, or dissolve the agreement definitively.

Force majeure is any circumstance beyond our will and control that prevents the fulfillment of our obligations in whole or in part. By this we understand, among other things, strikes, fire, business failures, power failures, failures in a (telecommunication) network or connection or used communication systems and / or the unavailability of our website at any time, non-delivery or late delivery of suppliers or other third parties engaged, ...
11. Intellectual Property
Our website, logos, texts, photos, names and in general all our communication are protected by intellectual property rights that are either with us or with our suppliers or other entitled parties.
It is prohibited to use and/or make changes to the intellectual property rights as described in this article.
For example, you may not copy or reproduce drawings, photos, names, texts, logos, color combinations, etc. without our prior and explicit written permission.
12. Complaints procedure and disputes
We always hope that all our customers are 100% satisfied.

We do everything we can to handle your complaint within 5 working days.
All agreements that we conclude with our customers, regardless of their place of residence, are exclusively governed by Belgian law and only the competent Belgian courts are competent in the event of disputes. If, for reasons of international law, another law nevertheless applies, the interpretation of the current general terms and conditions will primarily be based on the Belgian Market Practices and Consumer Protection Act.
